How Will Marriage Affect My Disability Benefits?

Last week, we wrote a blog post answering a question that was sent to us through Facebook. We received some great feedback and readers have suggested that they’d like us to make this a regular thing. Question: How will marriage affect my disability benefits?

Getting married may affect your disability benefits in a variety of ways. This is largely dependent on what type of benefits you receive—Supplemental Security Income (SSI) or Social Security Disability Insurance (SSDI).

If you receive SSI benefits, you likely already know that eligibility is determined based on your income and financial resources. Once you get married, the SSA will “deem” a portion of your spouse’s income to your record. Essentially, this means that they will consider your future husband or wife’s income to be your income as well. This may significantly reduce your monthly payment or even cause the SSA to terminate your benefits altogether.

It is important to note that, if you live with your significant other but are not yet married, the SSA may still decide to deem some of your partner’s income to your record.

If you receive SSDI on your own earnings record, getting married will have no impact on your benefits—no matter how much money your future spouse earns. If you receive SSDI based on someone else’s earnings record, your benefits could be affected in the following ways:

  • If you receive SSDI benefits under an eligible parent’s record, getting married will cause your benefits to be terminated. The only time benefits will not be terminated in this circumstance is if you are marrying another disabled adult child.
  • If you are currently receiving SSDI benefits on the work record of an ex-spouse, your benefits will be terminated if you remarry. This also applies to individuals who receive SSDI on the record of a deceased ex-spouse who remarry before age 50 if disabled, and before age 60 if not disabled.

Before you make any decisions regarding marriage or disability benefits, you should always consult with an SSA representative. That way, you can avoid unknowingly compromising your benefits. If the child is receiving disability based on the mother's income, then yes, it may change if (1. You two are married and thus her income changes because your income would be counted along with hers for determining benefits and (2. Your state's guidelines for child support define child support as income for the purposes of calculating child disability benefits.

it may not affect anything as social security benefits are based on your income, but either of you may become eligible for benefits on the other's work record if the amount is higher than what you would get on your own record.

Yes, your benefits may change as combined household income may be used to calculate eligibility for benefits. Your fiance's benefits may not change if he is receiving benefits based off of his work record.

You may not lose those benefits because of a name change, but to avoid confusion it is best to contact the SSA as soon as the name has been changed.

I get $1005 monthly for SSDI for stenosis in my back. I want to get married to a lady who makes 10,200 annually, not much uh. Would her income effect my government money or, either of our Insurances? Your benefits would not be effected, SSDI benefits are not based on income. If you are receiving income based benefits, then marriage may change your benefits.

Regardless of gender/sexual preference, the SSA calculates SSI eligibility for married couples by combined household income. So, you would lose benefits if it's established that your combined income is too high for SSI benefits.

It may if the SSA had calculated your eligibility for SSI benefits based on a single person household, they may calculate your benefits based on you and your husband's combined income. It may be a good idea to contact the SSA regarding this, they can give you detailed information as to how that process works in your case.

You can contact the SSA, they can let you know if you are receiving benefits on another person's work record or your own. If you're receiving benefits on your own work record, your benefits may not change after marriage.

If you're applying for SSDI benefits, then that won't really matter as those benefits are based off of your work record rather than income and financial resources. If you're applying for SSI, then your spouse's income would matter in this case.

I am currently recieving adult disabled child benefits @ age 24. I am contemplating marrying my boyfriend of 8 years. He is currently incarcerated. before he went to prison he recieved ssi benefits, and will recieve them when he gets out as well. Will marrying someone who recieves ssi affect my benifits? If you get married after age 60, you may still retain your survivor's benefits. However, your regular disability benefits will depend if they are work record based (SSDI) or if they are income based (SSI). If you receive SSDI, then they may not change. If you receive SSI, then they may change based on your and your future spouse's income.
