How Will Marriage Affect My Disability Benefits?

Last week, we wrote a blog post answering a question that was sent to us through Facebook. We received some great feedback and readers have suggested that they’d like us to make this a regular thing. Question: How will marriage affect my disability benefits?

Getting married may affect your disability benefits in a variety of ways. This is largely dependent on what type of benefits you receive—Supplemental Security Income (SSI) or Social Security Disability Insurance (SSDI).

If you receive SSI benefits, you likely already know that eligibility is determined based on your income and financial resources. Once you get married, the SSA will “deem” a portion of your spouse’s income to your record. Essentially, this means that they will consider your future husband or wife’s income to be your income as well. This may significantly reduce your monthly payment or even cause the SSA to terminate your benefits altogether.

It is important to note that, if you live with your significant other but are not yet married, the SSA may still decide to deem some of your partner’s income to your record.

If you receive SSDI on your own earnings record, getting married will have no impact on your benefits—no matter how much money your future spouse earns. If you receive SSDI based on someone else’s earnings record, your benefits could be affected in the following ways:

  • If you receive SSDI benefits under an eligible parent’s record, getting married will cause your benefits to be terminated. The only time benefits will not be terminated in this circumstance is if you are marrying another disabled adult child.
  • If you are currently receiving SSDI benefits on the work record of an ex-spouse, your benefits will be terminated if you remarry. This also applies to individuals who receive SSDI on the record of a deceased ex-spouse who remarry before age 50 if disabled, and before age 60 if not disabled.

Before you make any decisions regarding marriage or disability benefits, you should always consult with an SSA representative. That way, you can avoid unknowingly compromising your benefits. So my fiancé gets SSI for disability. In her case I don't ever see her working again. I've been with here for 8 years and have two children with her and would love to finally tie the knot and get married but she's afraid she will lose her benefits. I'm not rich by any means but have a steady full time job. Will she lose her benifits if we got married? It's like losing out on 740 a month if she were to lose her benefits, so if that's the case it's almost like why bother cause that would hurt us financially. if it doesn't affect her benefits that would be great cause it's the only thing holding back the completion of our little family.

Hi, my sister and my bro in law wants to get married, my bro in law receives SSDI, his family members called them and told them he will lose his benefits once he is married to my sister, especially Health Care wise, they are terrified because he gets seizures and if he goes under her minimum wage job medical benefits it will barley cover any of his medical expenses. If he is receiving benefits based off of his work record, his benefits would not change. If he is receiving benefits based off of his income, that may change but his eligibility for Medicaid may not change depending on your state's Medicaid eligibility guidelines.

Separated or not, you'd be eligible for benefits under his account if you're age 62, 50 and disabled, or sharing care for his child under age 16.

I am in the process of marrying my girlfriend and I get SSDI on my own record and earnings. Will my girlfriend be entitled to draw dependent or spouse's benefits off of my record? Will marriage affect my benefits or reduce it...also if she is entitled will there be a limit to how much income she can make while receiving benefits off my record?

If you're getting benefits based off of your work record, your spouse may be eligible for benefits under some circumstances, but your benefits would not be reduced due to marriage.

I am in the final stages on receiving my SSDI and will get my back pay. If I get married will that take away my back pay or just disqualify my future payments based on his income. Also will it stop the process of where I am at if I got married losing all of the back pay which I have worked for 30 year of my life before becoming disabled

My husband is already on disability. Now I am at a point where I am having extreme difficulty and may have to file for myself. We are both over 50. If I have to file, will we be penalized or will I receive less than what my SS report told me I would be getting, if I file for disability now? If you remarry before the age of 60, you cannot collect survivors benefits. If you remarry after age 60, you can still receive survivors benefits based on your former spouse’s record.

If I am married, can I receive health insurance benefits through Medicaid/SSDI if I am partially disabled and either cannot work at all or can only work PT? My husband has health insurance options for family, however we might not afford to get by on the premiums and constant doctor copays if I don't have an income. The SSA would only award benefits if you are considered disabled by their criteria, they do not award benefits for partial disability. You may be eligible for health benefits based off of your disability award, and marital status does not affect SSDI benefits.
