Gilbert Social Security Disability Appeal Hearings
If your initial application is denied, it is important that you do not panic. You have 60 days in which to file an appeal. During the appeals process, it is strongly recommended that you retain the services of an attorney or advocate.
In Arizona the Social Security Disability appeals process is made up of two stages—Reconsideration and Social Security Disability Appeal Hearing. Because many applicants are denied at Reconsideration, it is likely that you will be required to appear before an Administrative Law Judge (ALJ) at an appeal hearing.
Appeal hearings are typically held in a hearing office—or ODAR. Because there is no ODAR in Gilbert, you will have to visit a hearing office in one of the surrounding towns. The closest hearing office is in Phoenix.
Congressional Intervention
If your initial application and request for reconsideration are denied, you will then move on to schedule your hearing. Unfortunately, due to the backlog of cases at many hearing offices, the wait for an appeal hearing can last many months. If you find that you can’t wait until your appeal hearing—due to medical or financial emergency—you may wish to look into requesting congressional intervention.
This involves calling your local congressperson and explaining why you cannot wait for your appeal hearing. If he or she feels that you are a good candidate, they may be able to intervene with the hearing office to expedite your claim. Although this does not always work, it won’t have a negative effect on your claim.
