Qualifying children

Submitted by Anonymous (not verified) on

I have children and their father has recently went for a hearing is waiting on a decision. I was told that the kids will qualify for benefits. I have several questions.
How is the amount determined?
What are the rules for the cutoff age to recieve benefits?
Do the children recieve back pay as well?
What steps if any do I need to take to set up their case?
If a child is 18 but still in high school do they qualify, and for how long?

My husband just received the approval letter for disability. The letter mentioned our child, by name, may be eligible for benefits. She is a foster child we will be adopting in November. She has lived with us since December 2015. Do we apply for her benefits now or after the adoption is final?

Hi Timothy,
your child may be eligible for back pay, it may be a good idea to check in with the SSA to confirm if she is eligible.

I recently won custody of my daughter and in the court order it states that my ex wifes disability claim for our daughter now goes to our address. Does this happen automatically or is there something I need to do to ensure the money is delivered to the appropriate place?

hi John,
It may be a good idea to contact the SSA and make sure that you are listed as the representative payee for your daughter's benefits. You can call them at 1-800-772-1213.

I have been on SSD for 10 plus years I am about to get legal guardianship of my 11 year old grand daughter will she be eligible for benefits? My daughter just can't take care of her anymore
she is not disabled it is her marriage her husband is not the child father and its causing friction.

Hi. My husband and I have received temporary custody of our nephew through Dhr. We are waiting on a court date for temporary custody. Both of his parents are on disability and ordered to pay child support which we do not recieve. Can we apply for him to receive benefits from his parents even though we have temporary custody?

Hi Amy,
if they are receiving SSDI benefits rather than SSI, then your nephew may qualify for benefits on either of their work histories. I would contact the SSA, he may already be receiving benefits through them and they can change the payee to either you or your husband.

My ex-husband has been approved for disability. We have a hearing to amend child support due to this. What should I expect? I received part of his back check for the child support he owes but he owes a lot more.
He is telling me that our son has not gotten any support from his claim because we only have joint physical, not legal custody. Is this true? What do I need to do to start claim for my son or will it be handled through the child support hearing? My understanding is that they are separate legal issues.
