Waiting for decision

I became disabled in October of 2010 and applied for SSDI. I have been treated by my doctor every week since then and have retained an attorney for my SSDI process.

I have been paying in to the Social Security system for 38 years and am 55 years old. I had been at my last job for 20 years until I had to retire in June 2012 due to my disability.

During my hearing the judge asked the Vocational Expert if I would be able to do full time work in my present position and she told the judge that I would not be able to. The judge then asked I would be able to do full time work in any position and the VE answered no, that I would not.

My doctor also provided paperwork that stated that I have a total disability and could not do any work. I also provided a letter from my former boss who I worked directly for the entire 20 years stating that I was a dependable and dedicated employee until I started missing a lot of days during the summer of 2010 due to the start up of my disability.

I just found out that my case is with a Decision Writer and would be turning the case back over to the judge in a couple of weeks.

My question is, with my work history, age, doctors treatment and findings of the Vocational Expert, what would be my chances of being rewarded benefits?

I applied for disability and had a hearing on August 1st. I've been waiting for this answer to come in the mail but I haven't heard anything yet. I called social security to check on my disability claim status and they said that it was at the writers decision office. Just wondering on what that meant? Does that mean I'll be getting my decision in the mail soon?

Hi Duane,
It's not uncommon to not hear back from the SSA by now. You should hear by February of next year. But you could be receiving your decision soon! Your best bet would be to wait and see what happens.

You may find out soon what the results were, it may be a good idea to contact your lawyer and see if they have already been contacted if you had not done so before.

I had my appeal date Nov 9 2016 and today Dec 6 2016 I called to check on it and they stated it was in post hearing what does that mean?

Hi Latoya,
I really could not say, if it's in post-hearing that just means it's at that stage of the process, regardless of the decision that they make.

Have not had hearing but lawyer said my status is in decision writing....what does that mean? She said sounds hopeful...do you think so?

Hi Debbi,
That may mean that the ALJ is making their decision, it's part of the hearing process and may not have any bearing about the disposition of your case at all.

If my case is back to the judge for editing, does that ussually mean you are approved? Do they edit denials?

Hi Sherry,
It appears they may still be drafting your decision, so it may be that they're making sure that the decision is accurate. I really could not say if it's an approval or a denial based off of that.

I had a hearing for SSDI scheduled for 12/08/2016, but my attorney called me on 12/06/2016 and said my hearing was cancelled but the ALJ was going to approve my benefits OTR. Any idea on time frame for a decision letter and in turn back pay and monthly benefits? Thanks for any and all help!

Hi John,
I'm not sure about the decision letter's arrival, but once you receive it you should start getting monthly benefits around five months from that and back pay around four months after you start receiving benefits.

I think I'm a little confused. Do you mean it will take 5 months from the date of the letter to start getting benefits or back pay starts after 5 full months from when I applied and that I should get it about 4 months after benefits start? If you ate

Accidentally hit post when I was trying to fix "ate" to "are." If you are talking about 5 months to start after letter, why so long? Thanks for the help
