SSDI length of time for back pay?

Submitted by Anonymous (not verified) on

When I initially met with my attorney, I was told that back pay would go back one year from application, minus 5 months (I had already waited over 2 years to file because I was told I would have "full recovery" after my 2 fusion surgeries). I've received my acceptance letter but not my back pay yet, and during my search for more info on the process I came across a SSDI page stating that even if it takes 24 months for your claim to get approved, you can only receive pay for 12 months. Can anybody help clarify this for me please? Also, I have friends who received their back pay before or immediately after their approval letters (NY), but I've seen posts by people saying it took several months so I was wondering if there was a formula for when I can expect mine? I'm not looking to go on a spending spree, but I have a mortgage, car payment, property and school taxes, and children to feed and clothe as well as one in an expensive college. Thank you for taking the time to read this, and all input is appreciated.

If a partially favorable decision what onset date would be best guess at what the judge will go by ? First onset listed 10/2015, or the date the social security interviewer suggested based on my employment longevity of11/2014 or the date I turned “55” ? Which was in 2017

Hi Candy,
There are many factors that determine an onset date, I could not say what yours would be as we don't have any information on your case as we are not affiliated with the SSA.

Hi Theresa,
You may be eligible for benefits starting from your established onset date. I really could not say how much as it can vary.

Had my hearing Feb 2nd 2018. Judge made a fully fav for SDI and SSDI ruling from the bench. Informed her of my homelessness and financial situation. Will be owned 60,000 in back pay. Wondering if this might be fast tracked for paying me?

How did you find out the amount you would be payed and how long till you received it? I am in same boat with a fully favorable decision being processed but can not seem to get answers on the amount.

Hi Traci,

All of that information should be in the letter you receive once a decision is made! You just may not have received it yet if it is still processing.

I applied in 2015 when I literally crawled up 3 flights of stairs after work. Due to arthritis and back pain. I was turned down because I tried to work. I applied again in 2017 because I couldn't work and pain was too great. I received a call from SSDI that I was now approved but would only get payment for 2018 not 2015. How is that right?

Hi there,
If you re-apply rather than appeal your case, the SSA may use a later Established Onset of Disability (EOD) date for your case.
